Welcome to BestForStudies (the "Platform"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and BestForStudies ("we," "us," or "our"). By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Service Description
BestForStudies is an AI-powered visa compliance assessment platform that evaluates student visa eligibility for Australian student visas under Assessment Level 3 (AL3) and Ministerial Direction 115 (MD115) frameworks. Our service provides:
- Automated compliance audits based on user-submitted data
- Risk assessment scores and priority rankings
- Financial solvency calculations
- Genuine Student (GS) integrity checks
- Document recommendations for visa applications
2. Eligibility and User Responsibilities
2.1 Age Requirement
You must be at least 18 years of age to use this Platform. By using the Platform, you represent and warrant that you meet this age requirement.
2.2 Accurate Information
You agree to provide accurate, complete, and current information in all forms and data submissions. You acknowledge that inaccurate or incomplete information may result in incorrect audit results and potential visa refusal.
2.3 Account Security
If account creation features are implemented, you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

The Platform provides automated assessments based on algorithmic analysis and publicly available visa framework parameters.

- • Results are predictive in nature and subject to change based on policy updates, individual circumstances, and immigration officer discretion
- • You should consult a licensed migration agent or immigration lawyer before making any visa application decisions

4. Data Accuracy and Limitations
4.1 Framework Updates
Visa policies, exchange rates, and financial requirements are subject to change. While we endeavor to maintain current parameters, we do not guarantee that all data reflects the most recent policy updates.
4.2 Exchange Rate
The Platform uses a fixed exchange rate (1 AUD = 108 NPR) with a safety buffer. Actual exchange rates at the time of visa application may differ.
4.3 University Quota Status
Priority rankings are based on MD115 quota estimates. Actual university quotas may vary and are subject to change without notice.
5. Intellectual Property Rights
All content, software, algorithms, branding, and materials on the Platform are the exclusive property of BestForStudies and are protected by copyright, trademark, and other intellectual property laws. You may not:
- • Copy, modify, or reverse-engineer any part of the Platform
- • Use automated tools (bots, scrapers) to access the Platform
- • Resell or commercially exploit any audit results or Platform features
6. Prohibited Uses
You agree NOT to use the Platform to:
- • Submit false, misleading, or fraudulent information
- • Violate any applicable laws, including immigration fraud statutes
- • Attempt to circumvent security measures or access restricted areas
- • Interfere with the Platform's operation or other users' access
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
7.1 No Warranty
The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of accuracy, merchantability, or fitness for a particular purpose.
7.2 No Liability for Visa Refusal
We are NOT responsible for visa refusals, denials, delays, or any adverse immigration outcomes resulting from reliance on our audit results.
7.3 Cap on Damages
In no event shall BestForStudies be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or opportunity costs, even if we have been advised of the possibility of such damages.
7.4 Maximum Liability
Our total liability to you for any claims arising from use of the Platform shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.
8. Third-Party Services and AI Technology
8.1 AI Technology
The Platform utilizes AI for automated compliance analysis. We do not control or guarantee the accuracy of AI-generated outputs. AI assessments may contain errors or biases.
8.2 Third-Party Links
The Platform may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of service of any third-party sites.
9. Indemnification
You agree to indemnify, defend, and hold harmless BestForStudies, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Platform, violation of these Terms, or infringement of any third-party rights.
10. Termination
We reserve the right to suspend or terminate your access to the Platform at any time, without notice, for any reason, including but not limited to:
- • Violation of these Terms
- • Suspected fraudulent activity
- • Discontinuation of the Platform
11. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be posted on the Platform with an updated "Effective Date." Continued use of the Platform after changes constitutes acceptance of the modified Terms.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Nepal, without regard to conflict of law principles.
12.2 Dispute Resolution
Any disputes arising from these Terms or use of the Platform shall be resolved through binding arbitration in accordance with NEPCA Rules, except where prohibited by law.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BestForStudies regarding the use of the Platform and supersede all prior agreements and understandings.

16. Waitlist and Priority Ranking
16.1 Non-Guarantee of Service
Joining the Pre-Clearance Waitlist does not guarantee a university placement or a visa grant. It is an internal prioritization tool for processing audits.
16.2 Ranking Logic
Rankings are determined by our proprietary AI algorithm based on "Decision Ready" criteria (academics, funds, and integrity scores). We reserve the right to adjust rankings at our discretion.
16.3 Waitlist Removal
We reserve the right to remove users from the waitlist if they provide false information or engage in behavior that violates these Terms.
17. Referral Program
17.1 Eligibility
To participate, users must have a valid account on BestForStudies. Self-referrals (referring yourself using a different email) are strictly prohibited.
17.2 Valid Referrals
A "Valid Referral" occurs when a new user signs up and completes a profile audit using your unique link.
17.3 Prohibited Conduct
Users may not use "spam" tactics, automated scripts, or misleading advertisements to gain referrals.
17.4 Modification
BestForStudies reserves the right to modify or terminate the Referral Program and any associated rewards or rank boosts at any time without prior notice.
